Terms of Service

Welcome to Bluecrest Pools LLC (“Company”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our pool services, including maintenance, repairs, installations, and other related services (“Services”). By verbally agreeing to begin service, you also consent to receive automated service-related SMS messages (such as technician arrival alerts, service confirmations, and schedule updates). By using our services, you agree to comply with and be bound by these Terms.

 

1. Services Provided

1.1. Scope of Services: We offer a variety of pool-related services, including but not limited to regular maintenance, cleaning, repairs, installations, and inspections. The specific services to be provided will be detailed in the Service Agreement.

 

1.2. Service Agreement and Consent:

A formal written agreement is not required. By verbally agreeing to begin service (in person, over the phone, or via text), you accept these Terms, including service scope, pricing, and schedule. You are not bound by a long-term contract and may cancel at any time in accordance with Section 7.1.

1.3. SMS Communication & Consent:

By providing your phone number and accepting service, you consent to receive automated service-related SMS communications from Bluecrest Pools LLC. These may include technician en route notifications, service confirmations, and schedule updates. Standard messaging rates may apply. You may opt out at any time by replying “STOP” or contacting us in writing.

2. Payment Terms

2.1. Pricing: Our pricing is based on the services selected and will be clearly outlined in the Service Agreement. Prices are subject to change, but you will be notified of any changes in advance.

 

2.2. Payment Schedule: Payments are due according to the schedule specified in the Service Agreement. Late payments may result in additional charges.

 

2.3. Deposits: For certain services, a deposit may be required. The deposit amount and due date will be outlined in the Service Agreement.

 

2.4. Late Fees: Payments not received by the due date may incur a late fee of [insert late fee percentage] per day until payment is received in full.

 

3. Service Schedule

3.1. Regular Maintenance: Regular maintenance will be performed according to the schedule agreed upon in the Service Agreement. If you need to reschedule a service, please contact us at least three days in advance.

 

3.2. Delays: We strive to provide services on the agreed schedule, but unforeseen circumstances (e.g., weather, emergencies) may cause delays. We will notify you as soon as possible if a delay occurs.

 

4. Client Responsibilities

4.1. Access: You agree to provide us with necessary access to your property to perform the services. Failure to provide access may result in additional charges or rescheduling fees.

 

4.2. Utilities: You are responsible for providing necessary utilities (e.g., water, electricity) to facilitate the services.

 

4.3. Safety: You agree to ensure that the work area is safe for our staff. This includes securing pets, ensuring the pool area is clear of obstacles, and informing us of any potential hazards.

 

5. Warranties and Guarantees

5.1. Service Guarantee: We guarantee the quality of our services. If you are not satisfied with the service provided, please contact us within 30 days to address the issue.

 

5.2. Warranty on Parts: Any parts or equipment provided by us will be covered under the manufacturer's warranty. We do not offer any additional warranties on parts.

 

5.3. Exclusions: Our warranty does not cover issues resulting from misuse, neglect, or unauthorized modifications to the pool or equipment.

 

6. Liability

6.1. Limited Liability: Our liability is limited to the cost of the service provided. We are not responsible for any indirect, incidental, or consequential damages arising from our services.

 

6.2. Insurance: We carry liability insurance for the services we provide. A certificate of insurance can be provided upon request.

 

7. Cancellation and Termination

7.1. Cancellation by Client: You may cancel the services by providing a one month written notice (acceptable via email or text). Any prepaid amounts will be refunded on a prorated basis, less any applicable cancellation fees.

 

7.2. Termination by Company: We reserve the right to terminate services for non-payment or breach of these Terms. Upon termination, any outstanding balances will be immediately due.

 

8. Dispute Resolution

8.1. Governing Law: These Terms are governed by the laws of the state in which the services are provided.

 

8.2. Arbitration: Any disputes arising out of or related to these Terms or the services provided will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

 

9. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be communicated to you in writing and will become effective upon your continued use of our services.
